SACP Welcomes Constitutional Court Ruling on Labor Brokering

The South African Communist Party welcomes the definitive clarity provided by the Constitutional Court on Thursday, 26 July 2018. The ruling dealt a blow to the misinterpretation of the 2014 Labour Relations Act amendments, and will help bring an end to the many exploitative practices associated with labour brokering.

The amendments defined employers who use labour brokers to hire workers earning below R205 433 per annum as the direct and sole employers of those workers after three months. However, and consistent with their capitalist greed, many employers worked together with labour brokers and deliberately misinterpreted the amendments in order to continue sucking the blood of workers to maximise profit.

The SACP reiterates its solidarity with workers and the labour movement as a whole in the fight against labour brokering, and calls on employers to comply with the judgment without any further delay. Workers need to remain organised and vigilant as employers will not stop using all the tricks in the book to undermine their hard won gains.

The SACP further calls on all trade unions to unite, defend the gains scored from the 2014 Labour Relations Act amendments and together push the struggle to enforce the common interests of workers.
